TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP"). By accessing or using our websites, platforms or services, you agree to be bound by these Terms.

For Advertisers, these Terms also include the Listing Agreement, incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement, the Listing Agreement prevails for listing specifics.

These Terms apply to all HALP platforms including www.halp.com.au and www.boutiquedevelopments.com.au. By accessing or using our services you represent you are at least 18 years old and have authority to enter this agreement. We may modify these Terms; continued use constitutes acceptance.

2. Description of Services

HALP operates property discovery and business directory platforms. We facilitate connections between property seekers and providers — we are NOT a real estate agent, developer, builder, or financial advisor.

Property listing inquiries go directly to the listing agent/developer — HALP does not store or process them. Platform inquiries (Contact Us, Join Us, Advertise With Us) are managed by HALP in Pipedrive/ActiveCampaign and Google Drive.

Services are provided "as is" and "as available". Our platform is delivered via AWS, Stripe, Pipedrive, ActiveCampaign and Google Workspace.

3. User Accounts and Registration

You may need an account for certain features. You must provide accurate information, maintain confidentiality of your credentials, be at least 18 and have a valid ABN/ACN for business accounts. You are responsible for all activity under your account.

We may suspend or terminate your account for breach, false information, fraud, non-payment or extended inactivity.

4. User Conduct and Prohibited Activities

You agree to comply with laws, use services lawfully, provide accurate information and respect intellectual property. Prohibited: automated scraping, disruption, unauthorized access, harmful content, spam, phishing, impersonation, illegal activity, harassment, and commercial misuse. Violations may result in suspension, removal of content or legal action.

5. Property Listings and Information

Property listings are provided by developers, agents and third parties. HALP does not verify all listing information and does not endorse specific properties. Property information may change without notice. Always verify critical information directly with the provider.

We disclaim all warranties regarding accuracy, completeness, currency, availability, fitness or title of properties.

5.4 School Zone Information

School zone data is sourced from government databases and third parties, provided for general reference only. Always verify current zones with the relevant education department and each school. Enrolment is not guaranteed.

6. Business Directory Listings

Business listings require a valid ABN/ACN, legitimate operation, accurate information and necessary licenses. Listings must not contain misleading claims, unsubstantiated statements, prohibited content or infringing material.

Free and premium subscriptions are offered. Premium subscriptions require payment, auto-renew unless cancelled and are subject to separate subscription terms. Advertisers are responsible for handling inquiries in compliance with privacy laws.

7. Payment Terms (Advertiser Subscriptions)

Pricing is as displayed on our website or checkout, or in the applicable Listing Agreement. Pricing may change with 30 days notice. All fees are in AUD, exclusive of GST unless stated. Payments are processed via Stripe (PCI-DSS Level 1). Subscriptions auto-renew unless cancelled.

Refunds: no refunds for voluntary cancellation; pro-rata refunds for technical issues preventing service access; processed within 14 business days. Payment failures may result in service suspension after 7 days and listing removal after 14 days.

8. Intellectual Property Rights

All content on our platforms is owned by HALP or licensed to us. We grant you a limited, non-exclusive, non-transferable licence to access our platforms for personal, non-commercial purposes. Copyright issues: legal@halp.com.au.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, investment, legal, tax or real estate advice. Our calculators and tools provide estimates only. Always consult qualified professionals. Data may contain errors or be outdated.

10. Limitation of Liability

To the maximum extent permitted by law, HALP is not liable for direct, indirect, consequential or incidental damages. Where liability cannot be excluded, our maximum liability is $100 AUD (free services) or the lesser of $1,000 AUD or the amount you paid in the prior 12 months (paid services). Nothing excludes rights under the Australian Consumer Law.

You agree to indemnify HALP against claims arising from your breach of Terms, violation of law, use of services, submitted content or interactions.

11. Dispute Resolution

Contact legal@halp.com.au and allow 30 days for informal resolution. Governed by the laws of New South Wales, Australia. Optional arbitration in Sydney under ADRA rules. Class actions waived to the extent permitted by law.

12. General Provisions

13. Special Terms for Specific Services

Mortgage calculators provide estimates only. School zone data is for research only. Property alerts are sent based on your preferences. Home loan referrals may generate referral fees; brokers are independent third parties.
